Bienville Parish is served by the Second Judicial District Court, a Louisiana district court that also serves Claiborne and Jackson Parishes. Louisiana district courts are the state's general-jurisdiction trial courts. The official parish courts page states that the Second Judicial District Court has original jurisdiction over all civil and criminal matters not vested exclusively in another court, that most district court cases are heard by juries, and that the court has jurisdiction over criminal cases against children under seventeen.

Bienville Parish District Court Jurisdiction

The district court is the main trial court for Bienville Parish cases that are not assigned only to another court. Civil suits may include petitions, answers, motions, judgments, service returns, and court minutes. Adoption records are also not public, and sealed records are closed by court order. Public access to district court records therefore depends on both the court type and the confidentiality rule that applies to the file.

District Court vs JP Court

Bienville Parish does not use a Texas-style county court structure for the main trial-court records. The Second Judicial District Court is the primary local trial court, while Justice of the Peace courts handle smaller local civil matters within their statutory limits. The official parish court page says Bienville Parish JPs may perform marriage ceremonies and have civil jurisdiction where the amount in dispute does not exceed $5,000. It also says they cannot hear successions, probate matters, real-estate title disputes, suits where the defendant is the state or another political subdivision, or other excluded matters.

The Bienville Parish Clerk of Court is the local records custodian for court filings and many legal documents. The clerk handles land records, UCC filings, civil and criminal proceedings, marriage licenses, elections, and other legal documents. Civil records became available through Clerk Connect beginning November 2, 2023, according to the clerk civil page.

For criminal records, the clerk criminal department maintains citations, indictments, arraignments, dispositions, and evidence submitted during proceedings. The public search does not include arrest records, juvenile records, sealed documents, or offenses outside Bienville Parish. Criminal history searches are $20 per name for the past 10 years, with another $20 for each additional 10-year period. Criminal copies, excluding minutes, are $1 per page, and minutes are $10 per extract or date.

Bienville Parish Appeals

Appeals from the Second Judicial District generally route to the Louisiana Court of Appeal, Second Circuit, with further review by the Louisiana Supreme Court when allowed. An appeal record is not the same as the original district court case file. The trial court and clerk maintain the original filings, minutes, exhibits, and judgment. The appellate court reviews the record according to appeal rules and creates its own docket entries, briefs, orders, and opinions.
